The Victorian Independent Remuneration Tribunal sets remuneration bands for public sector executives and issues guidelines to help employers determine pay within those bands. In most cases, individual employers make the final decision about what their executives are paid.
In limited circumstances, employers may consider paying above the band. Before doing so, they must seek and consider the Tribunal’s advice, although they are not required to follow it.
Only a small number of executives are paid above the band. This suggests the bands are generally fair, equitable and competitive for the vast majority of executives. In the most recent financial year, the Tribunal received requests for less than 1 per cent of all public sector executives.
Even so, there may be legitimate reasons to pay above the band in particular cases — for example, to respond to market pressures or retain critical staff until a project is completed. The Tribunal does not seek to set bands that suit every executive role in every circumstance.
When providing advice, the Tribunal draws on robust evidence and considers both the requirements of the role and the skills and experience of the executive in the role. It is guided by the need to:
- enable public sector employers to attract and retain executives to deliver the government’s agenda
- ensure fair and equitable remuneration across the public sector
- maintain the integrity of the public sector executive employment and remuneration framework.
Employers are encouraged to contact the Tribunal Secretariat at enquiries@remunerationtribunal.vic.gov.au before they request the Tribunal's advice if they would like further information or have any queries.

Published advice
The Tribunal publishes the advice provided to employers on this website, where appropriate. This supports greater transparency, accountability and evidence-based decision-making on executive remuneration.
The Tribunal has only published advice provided to employers from 2020 onwards, following the Tribunal’s first Determinations for public service executives in May 2020 and for public entity executives in December 2020.
The Tribunal does not publish its advice where publication would not be in the public interest.
These factors account for the discrepancy in the sequence of advice numbers.
The Tribunal’s advice has been de-identified in line with the Tribunal’s Privacy Policy.
